1. GENERAL PROVISIONS
1.1. This User Agreement (hereinafter referred to as the "Agreement") applies to the website www.vi.community (hereinafter referred to as the "Site") of the VI Community Club (hereinafter referred to as the "Club").
1.2. The Site is the property of Individual Entrepreneur Irina Vladimirovna Lopatina (TIN 770702835290) (hereinafter referred to as the "Owner").
1.3. This Agreement regulates the relationship between the Site Club Administration (hereinafter referred to as the "Site Administration") and the User of this Site.
1.4. The Site Administration reserves the right to change, add or delete clauses of this Agreement at any time without notifying the User.
1.5. The User's continued use of the Site implies acceptance of the Agreement and changes made to this Agreement.
1.6. The User is personally responsible for checking this Agreement for changes.
2. DEFINITIONS OF TERMS
2.1. The terms listed below have the following meaning for the purposes of this Agreement:
2.1.1. "Site Administration" - authorized employees responsible for managing the Site on behalf of the Owner.
2.1.2. "Site User" (hereinafter referred to as the "User") - a person who has access to the Site through the Internet and uses the Site.
2.1.3. "Site Content" (hereinafter referred to as the "Content") - protected results of intellectual activity, including literary works, their titles, introductions, annotations, articles, illustrations, covers, musical works with text or without text, graphic, textual, photographic, derivative, composite, and other works, user interfaces, visual interfaces, names of trademarks, logos, computer programs, databases, as well as the design, structure, selection, coordination, appearance, overall style and location of this Content, included in the Club Site and other intellectual property objects collectively and/or separately contained on the Site.
3. AGREEMENT SUBJECT
3.1. The subject of this Agreement is to provide the User with access to the services contained on the Site.
3.1.1. The Club provides the User with the following types of services:
● Access to Content for free with the right to purchase Club services and view Site content;
● Access to search and navigation tools on the Site;
● Provision of the opportunity for Users to post messages, comments, and reviews;
● Access to information about Club services provided on a fee basis, as well as promotions and events;
● Other types of services, implemented on the Club's website pages.
3.1.2. All existing (currently functioning) Club services, as well as any subsequent modifications and additional services (services) that may appear in the future, are covered by this Agreement.
3.2. Access to the Site is provided free of charge.
3.3. This Agreement is a public offer. By accessing the Site, the User is considered to have joined this Agreement.
3.4. The use of Site materials and services is regulated by the norms of the current legislation of the Russian Federation.
4. RIGHTS AND OBLIGATIONS OF THE PARTIES
4.1. The Site Administration has the right to:
4.1.1. Change the rules for using the Site, as well as change the content of this Site. Changes come into force from the moment of publication of the new version of the Agreement on the Site.
4.1.2. Restrict access to the Site in case of violation of the terms of this Agreement by the User.
4.1.3. Establish, cancel, change the payment amount, if any, for providing access to use the Site or any of its sections.
4.2. The User has the right to:
4.2.1. Access to use the Site after complying with the registration requirements and, in case of joining the Club on a paid basis - payment.
4.2.2. Use all available services on the Site, as well as purchase any services offered on the Site.
4.2.3. Ask any questions related to the Club's services using the contact information provided in the "Contacts" section of the Site.
4.2.4. Use the Site solely for the purposes and in the manner provided for in the Agreement and not prohibited by the legislation of the Russian Federation.
4.3. The Site User undertakes:
4.3.1. Provide, at the request of the Site Administration, additional information that is directly related to the services provided by this Site and the Club.
4.3.2. Comply with the property and non-property rights of authors and other right holders when using the Site.
4.3.3. Not to take actions that may be considered as interfering with the normal operation of the Site.
4.3.4. Not to disseminate, using the Site, any confidential and protected by the legislation of the Russian Federation information about individuals or legal entities.
4.3.5. Avoid any actions that may violate the confidentiality of information protected by the legislation of the Russian Federation.
4.3.6. Not to use the Site to distribute advertising information, except with the consent of the Site Administration.
4.3.7. Not to use the Site services for the purpose of:
4.3.7.1. Uploading content that is illegal, violates the rights of any third parties; promotes violence, cruelty, hatred and (or) discrimination on racial, national, gender, religious, social grounds; contains false information and (or) insults against specific individuals, organizations, government bodies.
4.3.7.2. Encouraging unlawful actions, as well as assisting individuals whose actions are aimed at violating restrictions and prohibitions in force on the territory of the Russian Federation.
4.3.7.3. Violating the rights of minors and (or) causing harm to them in any form.
4.3.7. 4. Violating the rights of minorities.
4.3.7. 5. Representing oneself as another person or as a representative of an organization and/or community without sufficient authorization, including as a Club employee.
4.3.7. 6. Misleading users about the properties and characteristics of any services offered by the Club and posted on the Site.
4.3.7. 7. Making inappropriate comparisons between services, as well as creating negative attitudes towards individuals who do not use certain services or condemning such individuals.
4.4. Users are prohibited from:
4.4.1. Using any devices, programs, procedures, algorithms, or methods, automated devices or equivalent manual processes to access, acquire, copy, or track the content of the Site;
4.4.2. Disrupting the proper functioning of the Site;
4.4.3. Using any means to bypass the navigation structure of the Site to obtain or attempt to obtain any information, documents, or materials that are not specifically provided by the services of this Site;
4.4.4. Gaining unauthorized access to the Site's functions, any other systems or networks related to this Site, or any services offered on the Site;
4.4.5. Conducting reverse searches, tracking, or attempting to track any information about any other user of the Site.
4.4.6. Using the Site and its content for any purposes prohibited by the legislation of the Russian Federation, as well as inciting any unlawful activity or other activity that violates the rights of the Club or other individuals.
5. USAGE OF THE WEBSITE
5.1. The Website and its Content belong to and are managed by the Website Administration.
5.2. The Content of the Website may not be copied, published, reproduced, transmitted or distributed in any way, nor may it be posted on the global network "Internet" without the prior written consent of the Website Administration.
5.3. The Content of the Website is protected by copyright, trademark law, other rights related to intellectual property, and unfair competition law.
5.4. The purchase of services offered on the Website may require the creation of a User account.
5.5. The User is personally responsible for maintaining the confidentiality of the account information, including the password, and for all activity carried out on behalf of the User's account.
5.6. The User must immediately notify the Website Administration of any unauthorized use of their account or password or any other security breach.
5.7. The Website Administration has the right to unilaterally terminate the User's account if it has not been used for more than 6 (six) consecutive calendar months without notification to the User.
5.7. This Agreement applies to all additional terms and conditions for the purchase of services provided on the Website.
5.8. The information posted on the Website should not be interpreted as a modification of this Agreement.
5.9. The Website Administration has the right to make changes to the list of services offered on the Website and/or the prices applicable to such services at any time without prior notice to the User.
5.10. The documents specified in clauses 5.10.1 - 5.10.4 of this Agreement regulate to the extent appropriate and apply to the User's use of the Website. The following documents are included in this Agreement:
5.10.1. Privacy Policy;
5.10.2. Public Offer Agreement;
5.10.3. Application for membership in the Club;
5.10.4. Proposals and Comments.
5.11. Any of the documents listed in clause 5.10. of this Agreement may be updated. Changes take effect from the moment they are posted on the Website.
6. LIABILITY
6.1. Any losses that the User may incur as a result of intentional or negligent violation of any provision of this Agreement, as well as as a result of unauthorized access to the communications of another User, shall not be reimbursed by the Site Administration.
6.2. The Site Administration shall not be liable for:
6.2.1. Delays or failures in the process of conducting transactions that have arisen due to force majeure, as well as any malfunctions in telecommunications, computer, electrical and other related systems.
6.2.2. The actions of translation systems, banks, payment systems, and delays associated with their work.
6.2.3. The proper functioning of the Site, in the event that the User does not have the necessary technical means to use it, and also does not have any obligations to provide users with such means.
7. VIOLATION OF THE USER AGREEMENT
7.1. The Site Administration may disclose any information collected about the User of this Site if such disclosure is necessary in connection with an investigation or complaint regarding the illegal use of the Site, or for the purpose of identifying the User who may be violating or interfering with the rights of the Site Administration or the rights of other Site Users.
7.2. The Site Administration has the right to disclose any information about the User that it deems necessary to comply with applicable law or court decisions, to ensure compliance with the terms of this Agreement, to protect the rights or safety of the organization's name, Users.
7.3. The Site Administration has the right to disclose information about the User if Russian Federation law requires or permits such disclosure.
7.4. The Site Administration has the right to terminate and/or block access to the Site without prior notice to the User if the User has violated this Agreement or the terms of use of the Site contained in other documents, or in the event of the Site's termination or due to a technical malfunction or issue.
7.5. The Site Administration is not responsible to the User or third parties for the termination of access to the Site in the event that the User violates any provision of this Agreement or any other document containing terms of use of the Site.
8. DISPUTE RESOLUTION
8.1. In case of any disputes or disagreements between the Parties to this Agreement, a mandatory condition before applying to the court is the submission of a claim (a written proposal for a voluntary settlement of the dispute).
8.2. The recipient of the claim, within 30 calendar days from the date of its receipt, informs the claimant in writing about the results of the claim consideration.
8.3. In case it is impossible to resolve the dispute voluntarily, any Party has the right to apply to the court at the location of the Owner for the protection of their rights provided by the current legislation of the Russian Federation.
8.4. Any claim regarding the terms of use of the Site must be filed within 30 calendar days after sending the corresponding claim to the violator, except for the protection of copyright to materials protected in accordance with the law on the Site.
9. ADDITIONAL CONDITIONS
9.1. The Site Administration does not accept counter proposals from the User regarding changes to this User Agreement.
9.2. User reviews posted on the Site are not confidential information and may be used by the Site Administration without restrictions.

8. DISPUTE RESOLUTION
